1. HOW TO ENTER: "Goody's® Pass for Fast Sweepstakes" ("Sweepstakes") starts 7/15/09 and ends12/31/09. Two (2) ways to enter: Either: (A) Print your name, complete address, and daytime phone number on an Official Entry Form available at participating stores and mail in a properly stamped envelope to: Goody's Pass for Fast Sweepstakes, P. O. Box 4149, Grand Rapids, MN 55730-4149; or (B) Legibly hand-print your name, complete address, and daytime phone number on a 3"x 5" card and mail in a properly stamped envelope to the address in (A) above. No mechanically reproduced, illegible or incomplete entries allowed. You may enter as often as you wish; but, each entry must be mailed in a separate properly stamped outer envelope. All entries become property of GlaxoSmithKline® ("Sponsor") and will not be returned. Sponsor shall not be responsible for incorrect or inaccurate entry information; lost, stolen, illegible, incomplete, postage-due, misdirected, mutilated, or late mail or entries. Entries must be postmarked by 12/31/09 and received by 1/8/10 to be eligible.
2. GRAND PRIZE: (1): One (1) Grand Prize Winner ("Winner") will receive a 4 day/3 nights' Prize Package for four (4) to a Race Weekend currently scheduled for March, 2010 in Martinsville, VA (sometimes referred to as "Prize Package"). The Prize Package consists of round trip coach airfare for four (4) from the major airport nearest Winner's residence to the Peidmont Triad International Airport, NC; 4 days/3 nights' hotel accommodations (two [2] standard rooms/double occupancy); ground transportation between hotel and track; four (4) tickets for the Saturday and Sunday Races; four (4) pit crew passes; access to the Goody's Suite; the opportunity to meet and greet Richard Petty and Tony Stewart, subject to their availability and Five Hundred Dollars ($500) spending money. All Race Weekend trip reservations and accommodations will be as arranged by Sponsor. All expenses not specified above, including, but not limited to, meals, beverages, mini-bar, souvenirs, gratuities, ground transportation to and from airports, transportation, accommodations and all other expenses involved in the actual use, participation in and enjoyment of the Prize Package, insurance, personal services, etc., are solely the Winner's responsibility. Travel companions may not be minors in their state of residence unless Winner is their parent/legal guardian or spouse. Winner and travel companions must possess required travel photo identification documents and must travel on same itinerary. Sponsor has no liability if the Race is cancelled or postponed for reasons beyond the control of Sponsor. Total Grand Prize ARV: $9,260 depending on city of origin. If Winner resides within 250 miles of Martinsville, VA, the Winner will receive Five Hundred Dollars ($500) car/mileage allowance in lieu of the round-trip airfare. The potential Winner must sign and return a notarized Affidavit of Eligibility/Compliance and Publicity/Liability Release, where allowed by law, including providing his/her Social Security Number for income tax purposes. S/he will also receive a Form 1099 in the amount of the actual retail value of the Prize Package as required by law. Failure to sign and return the required documents by the return date specified in the Prize notification letter will result in forfeiture of the entire Grand Prize and, time allowing, selection of an alternate potential Winner. Travel companions must also sign Publicity/Liability Release, where allowed by law, prior to ticketing. If Grand Prize is won by a minor in his/her state of residence, it will be awarded in name of the Winner's parent or legal guardian who must sign and return all required documents. Prize may not be redeemed for cash; nor is it transferable or substitutable except by Sponsor with one of equal or greater value. All federal, state and local taxes are solely the responsibility of the Winner.
3. DRAWING & ODDS OF WINNING: The name of the potential Winner will be selected in a random drawing to be held on or about 1/8/10 from among all eligible entries by an independent judging organization, whose decisions will be final in all matters pertaining to this Sweepstakes. The potential Winner will be notified by phone or mail on or about 1/14/10. Odds of winning depend on number of eligible entries received.
4. ELIGIBILITY: Sweepstakes open only to legal residents of AL, AR, FL, GA, LA, MS, NC, SC, TN, TX, and VA, 21 years of age or older as of date of entry, except officers, directors and employees (and members of their household or immediate family, i.e., parents, children, spouse, or siblings and members of their household) of Sponsor, its affiliates, divisions, subsidiaries; participating retailers, its advertising/ promotion agencies, judging organization; or any third party associated with the development, administration or supply to this promotion (collectively, "Sponsor & Others").
5. RELEASE: By participating in the Sweepstakes, all entrants release, indemnify and hold harmless Sponsor & Others from any and all liability, injuries, claims, damages, losses, or causes of action of any kind, whether to property or person, arising directly or indirectly out of the acceptance, possession, enjoyment, use and/or misuse of the Grand Prize or component of the Grand Prize including without limitation travel, overnight accommodations, attendance at and participation in Sweepstakes-related events, whether or not sponsored by Sponsor & Others and participation in this Sweepstakes including without limitation personal injury, death, property damage, defamation, infringement of intellectual property rights, and claims based on the rights of publicity, misappropriation of personality and privacy.
6. GENERAL CONDITIONS: By entering, participants agree to be bound by these Official Rules, and the decisions of the judges that shall be final in all matters pertaining to this Sweepstakes. Winner grants Sponsor the right to use his/her individual name, address, biographical information, photograph, and likeness, worldwide in any medium, for advertising, publicity & promotion purposes, and for any other such purposes as Sponsor so determines, without further compensation, except where prohibited by law. The interpretation of these Official Rules shall be governed by the laws of the Commonwealth of Pennsylvania. Any and all disputes will be resolved individually, and without resort to class action, in the appropriate courts in the Commonwealth of Pennsylvania exclusively, and subject to the laws of the Commonwealth of Pennsylvania. Should there be a conflict between the laws of the Commonwealth of Pennsylvania and any other laws, the conflict will be resolved in favor of the laws of the Commonwealth of Pennsylvania. All Federal, state and local laws Sweepstakes void in all jurisdictions other than AL, AR, FL, GA, LA, MS, NC, SC, TN, TX, and VA, and where prohibited, taxed or restricted by law. All federal, state and local laws apply.
